The Department of Criminal Law and Criminology, founded in 1992 at Kharkiv Institute of Internal Affairs, is currently a structural unit of the Educational and Research Institute No. 1 (training of specialists for pre-trial investigation bodies of the National Police of Ukraine) of Kharkiv National University of Internal Affairs.

Professors V. P. Yemelianov, V. M. Kuts, O. A. Martynenko, P. I. Orlov, and A. B. Blaha made a significant contribution to the formation of the Department. An outstanding role in the formation and comprehensive disclosure of the research and educational potential of the Department belongs to Doctor of Law, Professor, Honored Worker of Education of Ukraine Oleksii Mykolaiovych Lytvynov, who headed the Department from June 2010 to July 2022.

Since July 2022, the Department has been headed by Doctor of Law, Professor Yurii Orlov. In total, the department employs 17 people, including: 6 Doctors of Law, 9 Candidates of Law, 5 Professors, 7 Associate Professors.

Scientific work

The Department of Criminal Law and Criminology carries out a set of research works on three topics that have state registration in UkrINTEI:

  1. «Combating crime by criminal law and criminological means in the conditions of martial law and the post-war period», registration number 0123U104952;
  2. «Peculiarities of qualification of criminal offences related to the illegal use of humanitarian aid, charitable donations or free assistance for profit», registration number 0124U001343;
  3. «Bringing to responsibility persons who, knowing the social danger of their actions, provide their bank or payment details to third parties, which are subsequently used to commit criminal offences (criminal liability for so-called drops)», registration number 0124U001298.

Since the beginning of the full-scale aggression of the russian federation against Ukraine, the research activities of the department have acquired a specification in accordance with the demands of combating crime in times of war. A series of scientific papers was published on the problems of forming and implementing criminal law policy in times of war, qualification of war crimes, crimes against humanity (in the categories of international criminal law), genocide, crimes of aggression - planning, unleashing and waging an aggressive war. Special attention is paid to criminological studies of the phenomenon of modern Russian fascism, the peculiarities of its determination, criminal and criminogenic manifestations, counteraction to its spread, as well as criminological support for transitional justice.

During 2023-2024, the academic staff of the Department of Criminal Law and Criminology prepared and published more than 160 scientific works, including 4 monographs; 82 scientific articles, 12 scientific opinions on draft laws, 2 scientific and legal opinions on requests from practical units of National Police, etc.

On 19 April 2024, the Department of Criminal Law and Criminology, in cooperation with the Department of Criminal Procedure and Organisation of Pre-trial Investigation, Criminalistics and Forensic Science, organised and held the International Scientific and Practical Conference «Crime and Counteraction to It in the Conditions of War and in the Post-War Perspective: Interdisciplinary Panorama».

The main areas of the conference were:

  1. Criminal and legal means of combating crime in times of war:
  • the crime of aggression: national and international legal mechanisms of counteraction;
  • war crimes and war-related criminal offences: problems of legislation and law enforcement;
  • genocide and crimes against humanity: current issues of normative definition and qualification;
  • problems of criminal law protection of certain social benefits in times of war;
  • the draft of the new Criminal Code of Ukraine: a critical look.
  1. Criminological support for combating crime in times of war:
  • modern russian fascism: scientific diagnosis of the state, explanation of factors, prospects for counteraction; 
  • crime in wartime: national, regional and global trends in reproduction;
  • strategies and tactical approaches to combating crime in times of war in Ukraine.
  1. Criminal justice in the context of war.
  2. Modern problems of forensic science and trends in the development of forensic science in wartime.
  3. Transitional justice in the optics of sectoral legal and interdisciplinary studies:
  • foreign experience in the application of transitional justice: prospects and limitations;
  • problems of ensuring fair justice in the transitional period;
  • approaches to ensuring compensation for war-related damage;
  • establishing historical truth: methodology, timeframe, content, risks;
    institutional reforms aimed at preventing the recurrence of armed conflict in the future.

The conference was attended by more than 160 legal professionals, including recognised scientists - academicians of National Academy of Legal Sciences of Ukraine, Honoured Worker of Science and Technology of Ukraine, Honoured Education Worker of Ukraine, Honoured Lawyers of Ukraine, Corresponding Members of National Academy of Legal Sciences of Ukraine, Doctors of Law, Professors, Senior Researchers, and young scientists - higher education students. Employees of criminal justice agencies, as well as foreign colleagues from research and educational institutions of the United Kingdom, Romania, Bosnia and Herzegovina, and Czech Republic, showed great interest in the scientific event. All participants of the conference are directly involved in studying the patterns of reproduction of crime, effective implementation of measures to counteract it in the conditions of war and post-war transition, in particular in combining the cognitive and practical transformative potentials of criminal law, criminology, criminal executive doctrine, as well as criminal procedure and forensics.

In August 2023, the monograph «Crime and Counteraction to It in the Time of War: Criminal Law and Criminological Dimensions» by the Head of the Department, Doctor of Law, Professor Yurii Orlov was published. It is devoted to theoretical and practical issues of combating crime by criminal law and criminology in wartime. The author examines the principles and peculiarities of implementing criminal law policy as a systemic response to criminal threats of armed aggression, the problems of qualifying war crimes and war-related criminal offences, including those with signs of crimes against humanity under international criminal law. Along with criminal law, the author presents the results of applying criminological optics to identify, describe and explain the essence and determinants of the crime of aggression as a criminal performance, as well as the etiology, components and features of modern russian fascism. The specifics of the impact of military and anti-military factors on the criminogenic situation, its trends, problems of adaptability of the system of combating crime and ways to solve them are analysed. Attention is focused on the specifics of criminological support for transitional justice in Ukraine, the relevant areas of criminogenic risks.

The Department has a scientific group on criminal law, headed by Professor of the Department, Doctor of Law, Professor Andrii Yashchenko. The research work of the department's scientific club is carried out in the following main areas:

  • criminal law and criminological problems of combating crime in times of war;
  • criminal liability for war crimes and crimes against humanity;
  • gender component of criminal law policy: problems and prospects;
  • doctrinal and law enforcement issues in the development of the new Criminal Code of Ukraine;
  • criminological support of transitional justice.

According to the results of the competition of scientific works of applicants for the first (bachelor's) level of higher education of higher education institutions belonging to the sphere of management of Ministry of Internal Affairs of Ukraine in 2023-2024 in the nomination «Criminal Law and Criminology», the scientific work of the 3rd year cadet of Educational and Research Institute No. 1 Musiyko A.A. on the topic ‘Military violent crimes related to atrocities: features of motivation, mechanism of commission and counteraction to the spread’ took first place (diploma of the first degree). The supervisor is the Head of the Department, Doctor of Law, Professor Yurii Orlov.

Educational and methodical work

The Department conducts educational activities aimed at training specialists in educational and professional programs of the first (bachelor's) and second (master's) levels of higher education in the field of knowledge 08 Law, specialty 081 Law and the field of knowledge 26 Civil Security, specialty 262 Law Enforcement.

The Department of Criminal Law and Criminology has prepared and published textbooks «Criminal Law of Ukraine. General Part», «Criminal Law of Ukraine. Special Part», «Criminal Law of Ukraine (Questions and Answers)», workshop «Criminal Law of Ukraine (General and Special Parts)», practical manual «Memo for cadets of higher education institutions of Ministry of Internal Affairs of Ukraine on documenting crimes related to the armed aggression of the russian federation against Ukraine», online course «Actions of investigative teams of National Police on documenting crimes related to the armed aggression of the russian federation against Ukraine» (https://dspace.univd.edu.ua/items/576a7a73-79b8-43b7-a9d1-8ee529bd3a71), a scientific and practical manual «Investigation of War Crimes and War-Related Criminal Offences: Criminal Law, Criminal Procedural and Forensic Aspects» (2023, 2024), as well as scientific and methodological recommendations for the Main Investigation Department of National Police «How to protect animals from cruel treatment: organisational, criminal, criminal procedural and forensic aspects», and other scientific and methodological works.

Organizational work

The scientific and pedagogical staff of the department regularly conducts educational (curatorship) work with cadets of the institute, career guidance and legal education work with students of the graduating classes of comprehensive schools and other educational institutions of Chernivtsi region.

On September 29, 2022, a scientific-practical seminar-meeting was held at the base of the GDNP in Khmelnytskyi region with the participation of representatives of the criminal police units, pre-trial investigation, inquiries of the GDNP in Khmelnytskyi region, Khmelnytskyi scientific-research expert-forensic center of Ministry of Internal Affairs of Ukraine, Directorate of the Security Service of Ukraine in Khmelnytskyi region, as well as representatives of the department of criminal law and criminology. The purpose of the event was to study the experience of practical employees of National Police of Ukraine, Security Service of Ukraine in documenting and investigating criminal offenses committed under martial law, in particular in the de-occupied territories. Among other things, the subject of discussion was a wide range of problematic aspects of the qualification of collaborative activity, aiding the aggressor state, justification, recognition as legitimate, denial of the armed aggression of the russian federation against Ukraine, glorification of its participants, violation of the laws and customs of war. The law-enforcement and doctrinal approaches to the interpretation of the signs of composition of these criminal offenses, their qualification when distinguishing from adjacent compositions, ways of overcoming competition and collisions are outlined. As a result, it was possible to synchronize applied and theoretical aspects, reach an agreement on optimal approaches to the application of the law on criminal responsibility, improve the activities of practical units and strengthen the practical component of the educational process.
